What applies to executive employees?

Executive employees basically enjoy the same protection against dismissal as other employees. However, special features apply. Firstly, senior executives cannot lodge an objection with the works council when they receive notice of termination. On the other hand, the employer has the option of filing a motion to terminate the employment relationship against payment of a severance package as part of the dismissal protection proceedings. However, it often turns out in proceedings for protection against dismissal that the requirements for being a managerial employee are not met and that the alleged managerial employee is simply an employee.
