It has been known since 2020 that investigations are underway into suspected engine tampering in Fiat Ducato camper base vehicles.

As more and more details incriminating Fiat become public, many owners of affected motorhomes are increasingly concerned and are taking legal action. With this lawsuit, they are demanding compensation for their motorhome affected by the Fiat Ducato diesel scandal.

However, a majority of affected motorhome owners want to wait for further developments in the Fiat Ducato emissions scandal before taking legal action against the manufacturer of Fiat Ducato motorhomes (FCA Italy S.p.A.).

Again high nitrogen oxide limit transgressions with Fiat Ducato

Since December 2020, the Emissions Control Institute (EKI) of the German Environmental Aid (DUH) has examined a total of 7 different Fiat Ducato chassis with individual motorhome bodies.Among other things, the emissions of nitrogen oxides (NOx) and carbon dioxide (CO2) were determined.

Statute of limitations diesel scandal

On July 29, 2021, the Federal Court of Justice (BGH) had to decide on questions regarding the statute of limitations for claims for damages (Case No. VI ZR 1118/20). In 2013, the plaintiff purchased a passenger car equipped with a manipulated diesel engine of type EA189. In 2019, he filed a lawsuit and claimed damages from the manufacturer.

Default judgment against Fiat Chrysler

A default judgment (Case No. 19 O 737/21) was issued against the car manufacturer Fiat-Chrysler (now Stellantis), which is now also affected by the diesel scandal, at the Nuremberg-Fürth Regional Court on July 9, 2021.

Longer claim: Diesel scandal

Federal Court of Justice confirms: Claim for damages even after resale. On July 20, 2021, the German Federal Court of Justice (BGH) confirmed in two cases (Case No. VI ZR 533/20; VI ZR 575/20) that the claim for damages does not lapse even if the vehicle concerned has already been resold.
