To obtain an EU Blue Card, two basic steps are necessary. You need a category "D" national visa to enter Germany(entry visa) and you must apply for your EU Blue Card in person in Munich.

The requirements for the issuance of your entry visa correspond to the same requirements for your employment in Munich, i.e. the requirements for the EU Blue Card.

The requirements for applying for an EU Blue Card in Munich are:

  1. A recognized college degree,
  2. meeting the minimum salary threshold;
  3. and possibly the permission to practice the profession.

However, these requirements can be waived in certain cases. For example, there is an exemption for IT specialists that allows them access to the EU Blue Card even if they have not completed a university degree. However, they must be able to prove that they have worked in IT professions for at least three years in the past seven years and that they have theoretical knowledge equivalent to that of university graduates. Bureaucracy requires you to submit the same application twice. Once for entry for your visa and once to obtain your residence permit in the form of the electronic EU Blue Card.

Citizens of the following countries do not require an entry visa to apply for the EU Blue Card directly at the Foreigners' Registration Office in Munich: USA, Japan, United Kingdom of Great Britain and Northern Ireland, Canada, Australia, South Korea, Israel and New Zealand. You only need the second step.

Responsibilities for the EU Blue Card in Munich

In Munich, the Kreisverwaltungsreferat (KVR) is responsible for applying for the EU Blue Card. Here you must apply (again) for the issuance of an EU Blue Card and then appear in person at the authority to receive the so-called electronic residence title in the form of the EU Blue Card.

Jurisdiction outside Munich for the EU Blue Card

If you do not require an entry visa, want to live in Munich and want to apply for the EU Blue Card in advance from abroad and not in person at the Foreigners' Registration Office in Munich, the Munich Foreigners' Registration Office is also responsible according to the law (§ 7 Para. 1 S. 3 BayZustVAuslR).

However, it refuses to process applications unless the applicant is registered in Munich. In our view, this is a violation of the applicable jurisdiction ordinance.

Without entry visa

The option of applying for the EU Blue Card from abroad is a good and quick alternative for nationals who do not require an entry visa to apply for the EU Blue Card directly at the Foreigners' Registration Office in Munich.

With entry visa

We also advise our clients in cases where an entry visa is required and point out the possibility of the accelerated procedure within the meaning of Section 81a AufenthG. After completion of the accelerated procedure for skilled workers, you will receive a so-called preliminary approval and the diplomatic missions abroad are then obliged to set an appointment for the application for an entry visa within three weeks. At some German diplomatic missions abroad, you do not even need an appointment, but simply submit your documents. A decision on your application will then generally be made within a few weeks of submitting the documents.
