Permanent residence EU

Comparable to the settlement permit, the EU permanent residence permit is an unlimited residence title which entitles the holder to settle in Germany and, taking into account the regulations applicable there, also to settle in another EU country.

Requirements permanent residence EU

The receipt of the permit for permanent residence-EU (§ 9a AufenthG) is linked to various requirements. The following must be fulfilled in principle:

  • Duration of residence: You have been legally residing in Germany for at least 5 years.
  • Livelihood: Your livelihood and that of your family is secured by regular income
  • Language skills: You have sufficient knowledge of the German language (level B1).
  • Sufficient living space: you and your family have sufficient living space at your disposal
  • Legal and social order: You have basic knowledge of the legal and social order and living conditions in Germany
  • Public safety and order: There are no reasons of legal and social order against it.

Legal residence for 5 years

You must have been legally resident in the Federal Republic of Germany for at least 5 years. For this period, you must therefore possess or have possessed a residence title. In certain cases, it is possible to have periods in which you have resided outside the territory of the Federal Republic of Germany credited. However, this requires an examination of the individual case.

Secured livelihood

In order to obtain a permit for permanent residence in the EU, both your livelihood and that of your family must be secured. You must therefore be able to support yourself without recourse to public funds.

Whether your livelihood is secure depends on numerous circumstances, such as the amount of rent you pay and the number of family members you have.

Language skills

You must have sufficient knowledge of the German language. Level B1 of the Common European Framework of Reference for Languages is sufficient here.

The proof can be provided, for example, by a language certificate. You can acquire such a certificate, for example, by taking the "Deutsch-Test für Zuwanderer" (DTZ).

Proof by means of a language certificate is not necessary, for example, if you have a German (high) school diploma or have successfully completed at least four grades in a German school.

Sufficient living space

You and your family must have sufficient living space available. Whether the living space is sufficient is determined by its nature and occupancy.

In principle, the living space is sufficient if each family member under the age of six has ten square meters and each over the age of six has 12 square meters of living space. In addition, ancillary rooms such as the kitchen, bathroom and WC must be adequately usable. Infants under two years of age are not taken into account in this calculation.

Knowledge of the legal and social order

They must have sufficient knowledge of the legal and social order and living conditions in Germany.

You can prove this by successfully completing the "Living in Germany" test.

Public safety and order

In order to obtain a permit for permanent residence-EU, no reasons of public safety and order may stand in the way.

This is the case, for example, if you have been sentenced to a fine of more than 90 daily rates or to imprisonment of more than three months. In addition, reasons of public security and order prevent the issuance if you are a member of a terrorist or anti-constitutional organization or support such an organization.

Exclusion of the permit for permanent residence-EU

The granting of a permit for permanent residence in the EU may be excluded under certain circumstances due to your current residence title. This is the case, for example, if you have a residence permit for humanitarian reasons or a residence permit for the purpose of education.

Advantages of a Permit for Permanent Residence-EU - esp. comparison with Settlement Permit

The EU permanent residence permit brings with it all the advantages that a settlement permit also has. It is an unlimited residence title. Future visits to the authorities to renew the residence title are therefore no longer necessary. An unlimited residence title also offers significantly better planning security and thus opens up completely new possibilities with regard to personal and professional development. But what differentiates the permanent residence permit from the "ordinary" settlement permit?

The difference is already apparent from the name. While the settlement permit only allows you to settle in Germany (traveling to other EU states is possible, but not settling), the permanent residence EU permit entitles you to move on to another EU state. You can therefore also move to an EU state other than Germany and settle there if you meet the requirements of the other state.

Conclusion
