Fiat about to lose in Koblenz court (OLG) - Fiat Ducato emissions scandal

In the reference decision of 14.11.2022, the Fifth Senate speaks of two defeat devices in Fiat Ducato engines (Ref.: 5 U 1334/22; no judgment yet; as of Dec.2022). Among other things, the so-called timer, which optimizes the exhaust gas purification for the test bench. In this optimization, the exhaust gas recirculation rate is drastically reduced after 22 minutes, which leads to rapidly increasing emission values. In view of the statements in the information order, Fiat (FCA Italy S.p.A.) is likely to be condemned accordingly.
