What is protection against dismissal?

The Dismissal Protection Act (KschG)regulates the general protection against dismissal . If the KschG is applicable (cf. Sections 1, 23 KschG), a termination is only effective if it is socially justified. In addition, there are special protection against dismissal rules (maternity protection, parental leave, care leave, family care leave, severely disabled persons, works constitution bodies, trainees). In addition, a certain degree of protection against dismissal is provided in particular within the framework of the German Civil Code (BGB) (e.g. §§ 138, 242, 612a BGB).
